True View - General Terms and Conditions
- GeoCue makes no claims as to the suitability of our hardware or software products for a particular project need. You assume all responsibility for the selection of the tools you choose to execute your projects. We will provide sample data, specifications and advice but the ultimate selection is your sole decision.
- Aerial drone mapping operations are inherently dangerous. GeoCue assumes no responsibility or liability of any type in the event of a mishap. GeoCue’s flight training is only intended to provide information specific to the operation of GeoCue sensors. If you feel your skills with drone operations are not adequate, you should seek training from a qualified drone flight instructor.
- It is strongly recommended that you institute written safety plans that are tailorable to the unique conditions that may be present for a particular project.
- Drones carrying 3D Imaging Sensors have relatively high mass (they are “heavy”). We strongly recommend that your drone be equipped with an automatically deployable parachute system. Be aware that a parachute may fail in various modes and even if it does deploy, it will not fully protect the system from damage. Also be aware that a parachute system does not provide justification for flying over persons. A drone descending by parachute will still cause serious injury or even death to persons on the ground should a collision occur.
- You assume all responsibility for drone and sensor mishaps. GeoCue is not liable for flight incidents or damage, regardless of cause. If a mishap occurs with a drone and you feel the cause was a defect in the drone or related systems such as the controller, mission control system and so forth, you must arbitrate directly with the drone manufacturer even if you purchased the drone from GeoCue.
- It is strongly recommended that you carry adequate insurance to cover any liability and/or losses.
- GeoCue assumes no liability for direct or incidental damages such as lost time due to a sensor failure during a project or issues with data processing.
- While GeoCue provides guidelines on the number of project acres that can be collected with a certain number of kinematic minutes (kinmin), you should treat this for what it is; simple loose guidance. We make no guarantees as to what can actually be accomplished since there are numerous unpredictable project variables.
- Note that, unless they are “Dead on Arrival”, batteries and external cables for True View products are not covered under TrueView hardware maintenance.
- All prices are in USD, excluding taxes.
- Travel expenses, if applicable, will be invoiced following our on-site visit unless specifically priced in the pricing tables of this quotation. Travel expenses include airfare, rental car, hotel and daily meals at standard USA federal government per diem rates.
- Shipping expenses, unless specifically listed in the quotation, are not included and will be added to the final invoice.
- Invoices are payable Net 30 days.
- Prices are exclusive of any applicable taxes, import duties and other government-imposed fees unless they are specifically listed in the pricing tables of this quotation. These fees will appear on your invoice.
- On-site visit dates, if applicable, will be set based on a mutually agreed schedule.
True View - Additional Terms and Conditions (Purchased)
- Purchased True View systems are not returnable. Defective systems will be repaired or replaced, at GeoCue’s sole discretion. If you are located in the USA or Canada and you are not sure a True View system will meet your requirements, consider a True View Subscription. If you then decide the system meets your requirements, you can convert the Subscription to an “Owned” system by exchanging the subscription system for a purchased system. The remaining balance of your subscription system will be deducted from the cost of the purchased system.
- Purchased True View hardware includes the first year of hardware maintenance. There is not a hardware warranty separate from the maintenance agreement. Under hardware maintenance, GeoCue will repair or replace any defective components. Replacement components will be either new or refurbished, at GeoCue’s sole discretion. If the repair requires a return to factory, you will be responsible for shipping expenses to GeoCue’s Alabama office. If the repair is deemed “covered under maintenance”, GeoCue will pay the return shipping. If the repair is not covered under the maintenance agreement, you will be informed of the repair cost. If you elect to have us repair the system, you will be invoiced for the repair and the return shipping expenses.
- You will be provided firmware (software that runs on internal components within the True View hardware) updates so long as the system is under a current hardware maintenance agreement. Firmware is user installable from within the True View LP360 Drone software.
- Defects or failures that are caused by accidents, abuse or neglect are not covered under the maintenance agreement. Examples of abuse include but are not limited to rough handling of the sensor, opening sections of the system that are not user serviceable and overtightening of fasteners.
- Purchased True View systems include the first year of software maintenance. You will receive software technical support (by email) and all software updates while the software is under a current maintenance agreement. You will also be eligible to attend GeoCue’s online software training sessions for maintenance customers.
- Maintenance for hardware and software can be purchased following the first year at GeoCue’s then current maintenance pricing.
- Hardware maintenance cannot be purchased without a concurrent software maintenance agreement.
- After the initial (included) one-year hardware maintenance period, you may elect “per-incident” hardware repair rather than a hardware maintenance agreement.
- Hardware is not eligible for maintenance agreements or “per incident” repair unless the accompanying software (currently LP360 Drone and POSPac UAV) are under a current maintenance agreement.
- If you allow your hardware maintenance to lapse, you must return your hardware, at your expense, to GeoCue’s Alabama office for assessment before we can issue a new maintenance agreement.
- If you elect not to renew your software maintenance agreement on True View LP360 Drone, the software will continue to function. However, you will not receive software technical support nor any software updates or fixes.
